Inhoud

This course focusses on capita selecta of law of obligations and contract law, which are not examined (in depth) in the basic course.

The following topics can a.o. be disucssed:

- law of obligations : notion of subjective rights, prohibition on abuse of rights, good faith principle, notion of public order, nullity, liability …

- contract law:  notion of contract, auonomy of will / freedom to contract, conform delivery in sales contracts, fiduciary securities and reconversion, hardship, limitation of contractual liability, contractual inequality and abuse of position…

The aim is to reflect over the selected topics in light of the societal challenges ahead in particular in the context of ensuring a sustainable society.

The topics may vary from year to year.

If the group is limited (<40)  the classes are teached in an interactive manner based on the topics communicated previously during the classes. Per class a topic will be treated. Questions will be submitted to the students and the students are requested to prepare in small groups their response. Each group will be requested to present its response. In a group discussion the different responses are further discussed.

Students are expected to prepare the classes by performing research and readings on the discussed topics. Studens may receive reading assignments.

Students are expected to participate actively during the classes (participation to the discussion, responding to questions, peer review).

Given that the participation is permanently evaluated, presence to the classes is mandatory. 

If the group is too big (>40) than the classes will be organised around practical cases or legal issues to be prepared or written assignments may be given.

The working method will be communicated in the first class taking into account the number of students that enrolled for this course.

With this course students are able:

  • to situate the legal framework applicable to the examined topics and to explain the applicable principles in a logical and structured manner
  • to asses this legal framework in depth and in a critical manner 
  • to reflect, to enter in discussion and to exchange on the studied topics 
  • to cooperate in group

De beoordeling bestaat uit volgende opdrachtcategorieën:

Binnen de categorie Examen Andere dient men volgende opdrachten af te werken:

  • Examen Andere met een wegingsfactor 100 en aldus 100% van het totale eindcijfer.

Aanvullende info mbt evaluatie

The students are evaluated during the classes taking into account their preparation and their participation. Participation to the classes is thus mandatory.

The students can decide to be further evaluated during an oral exam. To this aim the quotation of the evaluation of the participation will be communicated in the last class. 

The quotation for participation is considered acquired. A further evaluation via oral examination can only lead to an increase of the quotation or to a status quo, not to a decrease. The quotation for participation can be maintained for a next exam period.  

In case of more than two justified absences, or in case of students under examination contract, the student will be evaluated via a written assignment and an oral exam.
